These terms set out the arrangement between you and FunkyIQ when you take out a subscription. Starting or continuing a subscription means you accept them.
FunkyIQ is a data model that reads Australian racing form and publishes ranked selections and win/place probabilities. You reach it through a one-off 5-day pass or through a monthly or annual membership.
We are an analysis service, not a wagering operator — we don't take bets, hold your money, or encourage you to gamble. Everything we publish is general in nature, for information and entertainment.
Our output is the same for every subscriber. It is not tailored to your finances, goals or situation, so treat it as one input among many and seek independent advice where a decision matters to you.
Paying the applicable fee gives you a personal, non-transferable right to use FunkyIQ while your subscription is active. It is for your own use, not for resale.
Selections are produced by statistical models. Racing is inherently uncertain: we cannot promise results, and past performance does not predict future outcomes.
We keep developing the product, so individual features may change, pause or improve over time.
You must be at least 18 years old to subscribe. You sign in using an email “magic link”, so keep your email account secure — anyone who can read it can reach your account. You are responsible for activity carried out under your account.
Please don't scrape, republish or resell our selections, data or other content without our written permission.
Don't treat FunkyIQ as your only reason to bet or spend money. The final decision, and its consequences, are always yours.
The service is provided on an “as is” and “as available” basis. We work to keep it reliable and available but can't guarantee it will always be uninterrupted or error-free.
We make no promise, express or implied, that any selection is accurate or will be profitable.
To the fullest extent the law allows, we are not liable for any loss, damage or expense arising from your use of, or reliance on, the service. None of this limits rights or remedies you have under the Australian Consumer Law that cannot be excluded.
The models, software, data and content that make up FunkyIQ belong to us or our licensors.
You may not copy, modify, reverse-engineer, or pass on the service or its output without our prior written consent.
We collect and handle your information in line with our Privacy Policy.
You agree that we may use de-identified data to improve our models and our analytics.
We may suspend or end your access if you breach these terms.
When access ends, your right to use the service ends with it. We may retain some records for backup and legal-compliance purposes.
This agreement is governed by the laws of [State/Territory], Australia, and you submit to the non-exclusive jurisdiction of the courts of that place.
We may revise these terms from time to time; the effective date at the top shows the current version, and continuing to use the service means you accept the changes.
